Abstract
Remarkable development of medicine enables us not only to prolong the quantity but also to make the quality of life better. It, however, makes the problem of life into more complication one that includes the law, ethics, religion and
economics
as well as medicine and biology. We have to bring a solution to the problem. Naturally, brain death and organ transplantation is another questions. But, if the debate about the organ transplan tation did not arise, the problem about the
brain
death couldn't catch the social attention. And, at now, we can't produce artificial organ implants at will, the above two problems are inseparable. It is because the fact that the most suitable organ for transplantation is one from the living
donor as
much as possible. So, the conference about the organ transplantation needs the scientific and lawful criteria of death but we can't deny that the pendulum, of social concerning is not to te scientific and lawfulness of criteria but to
practical
need of using the organs of a person in the state of brain death. The authors are now willing to investigate and discuss about 1) the medical standpoint about the brain death and organ transplantation and the status quo of the organ
transplantation,
2) the legal aspect and 3) the ethical aspect of the brain death and organ transplantation. In that way, we can estimate social understanding and legal value about the brain death and organ transplantation.
